The data show that the state-by-state trend toward an apparent prison population decline (per capita) may have plateaus in the years around 2005, but, for the most part, the national trend continues to demonstrate an ongoing trend (p<0.001) and the data actually show a slight decrease in the number of prisons in the United States from 1999–2004 (US Dept. of Justice 2004; US Dept. of Justice 2010). The reduction in the prison population is an indication of changes in the criminal justice system. As prisons became more of a focus while offenders were incarcerated, and the national prison population decreased, many states had a large number of the relatively more expensive drug-involved and serial offenders released to local communities. Rather than concentrate on rehabilitation and reentry to the community, as was the case when prisons first became a focus in the 1980s, the objectives of the criminal justice system became retribution, incapacitation, and/or punishment (Herczeg 2002; Block et al. 2003). According to a national assessment by the Pew Center on the States, the number of people in American prisons and jails in 2008 was equal to the population of Tulsa, Okla. (40,000).

In analyzing change over time in mental health and substance abuse treatment needs of those released from prison/jail, we found changes in the level of unmet need. A change of this magnitude requires the community to adjust to new developments. The data show an increase in the rate of unmet substance/alcohol abuse and mental healthcare demand for those states without a deinstitutionalization policy over the study period (p<0.01). This overall increase was most likely due to the relaxation of oversight, as well as some states repealing incarceration policy more proactively (e.g., California). Although the number of prisoners was reduced, and many states enacted a policy of parole supervision instead (Austin 2010; Turner and Tenhoor 1978), there were improvements in treatment services specifically for those returning from incarceration. Also, prison stays were generally shorter, and thus, there were more releases back into the community.
